摘要
本文在分析美国环境立法和执法状况的基础上 ,结合中国国情 ,提出了加快中国环境法制建设的建议。文章提出必须抓紧制定《环境影响评价法》,并把它作为国家保护环境的基本章程 ;必须健全环境管理体系 ,强化环境行政管理 ;必须完善环境司法体系 ,加大执法力度 ;必须建立公众参与机制 ,切实保障公民的环境权益。
The essay based on the analysis of American legislation and law enforcement,combined with China national condition,raises the suggestion of speedingup China environmental legislation building.The essay points out that the making of Environmental Impact Assessment Law, which should be regarded as basic charter of national environmental protection,is necessary and urgent;Environmental management system must be improved and environmental administrative management should be strengthened;Environmental judicial system must be perfected and enforcement of law should be strengthened; Public participation mechanism must be established in order to protect civilians' environmental rights.
