摘要
自新的《刑事诉讼法》修正案明确做出了"鉴定人应当出庭作证"的规定以后,针对司法鉴定人应当出庭作证的法律规定,文章深入分析制约鉴定人出庭的诸多因素,并结合实际问题,阐述了完善与该法律规定相配套的一系列法律保障制度。
The new amendment to Criminal Procedure Law explicitly stipulates expert witnesses should testify in court. According to the legal provisions that judicial expert witnesses should testify in court, this article further analyzes some factors restricting expert witnesses in court and elaborates methods of perfecting a series of matching law guarantee system.
