摘要
当前我国大学科技成果转化尚存有权利归属和利益分配不明确、知识产权保护和运营意识不强等法律问题。美国、日本等发达国家在保障大学参与协同创新方面提供了较好法律经验。要增强法律法规的可操作性,提高大学知识产权保护和运营意识,通过法律手段规范大学科技成果转化,充分发挥大学在协同创新中的作用。
Currently, some legal problems are still remaining in the transformation of scientific and technological achievement in domestic universities such as the unclearness of the ownership of rights and distribution of benefits, the weak awareness of intellectual property protection and operation, etc. Good legal experiences of participating in collaborative innovation from foreign universities are provid- ed. The operability of laws should be enhanced, the awareness of intellectual property protection and operation of universities should be raised and the achievement transformation be regulated by legal means, so as to give full play to the rule of universities in collaborative innovation.
