摘要
预先指示是有决定能力的成年人在预计到将来会丧失决定能力的情形下而预先表达自己意愿的声明。精神疾病可能会损害独立做出选择及决定的能力,这就使得预先指示与精神卫生法联系起来。预先指示允许有决定能力的人在发生一项将损害决定能力的精神疾病之前指明他的医疗选择或偏好。支持者认为该项制度能够促进个人自治,并使得有精神疾病的人能够参与到他们自己的将来的医疗决策之中。反对者则认为该制度会带来广泛的法律及道德问题,这就使其在实践中无法操作。鉴于预先指示制度在医疗、经济、人权方面的益处,我国在制定精神卫生法过程中应当对其予以考虑。
Presage is the statement which an adult with decision ability makes in the situation that he will lose his decision ability.Mental disease may hurt the ability for a man to make his choice or decision,so it connects presage with mental health law.Presage allows a man with decision ability to state his medical choice and his preference before a disease harmful to his decision ability will happen.The supporters think that it can promote personal self-governance and it can let the mental patients join in their future medical decision.However,the opponents think that this system will bring many problems of law and morality.So it can hardly be operated in practice.As the presage statement system has some interests in medical treatment,economy and human rights,it should be considered when we formulate our mental health law.
