摘要
近年来,针对未成年人的性侵害案件不断增多。这些案件中既有传统型性侵害案件,也有新型性侵害案件。未成年人的性权益尤其在新型性侵害面前无法得到有力的保障。究其法律成因,主要是因为现代人性观念的快速转变与性法律意识落后的矛盾尖锐,立法上对性侵害主体与范围规制过窄,以及司法方面的侦查取证方式不妥等因素共同导致。
Recent years, the cases regarding immaturity sexual abuse are increasing. Besides traditional types of sexual abuse cases, there are also some new types of sexual abuse cases. Immaturity sexual rights could not be effectively guaranteed, especially in the new sexual abuse. This paper investigates the legal causes to this problem, such as, sharp contradiction between the rapid change of modern conception of human nature and backward legal consciousness, and improper way of judicial investigation etc.
