摘要
近年来商品房市场发展迅猛,同时也伴生了一些法律问题,其中小区车位的法律地位一直处于含混未决的状态,包括小区地面车位的初始权属及转让问题。文章论述了小区地面车位的初始权属要依据小区的规划条件来认定,同时还需要考虑开发商与业主之间的约定。对于可以转让的小区地面车位,其转让的法律属性存在多种可能的法律认定,当前最为可能的认定是租赁权的出让,为保护业主的权利,可考虑借用地役权的制度对小区地面车位进行转让。
The rapid development of the real estate market in recent years has given rise to several legal issues,one of which is that,the legal status of the parking lots in residential districts remains unresolved.And the original ownership and the transfer of the ground parking lots in residential districts are among the unresolved problems.The original ownership of the ground parking lots in residential districts should be determined by the relevant city planning conditions,and the relevant agreement between the real estate developer and the owner should also be considered.If the ground parking lots can be transferred,the legal nature of the transfer is uncertain according to the present legal system,and the most possible legal nature may be the transfer of lease right,but in order to protect the owner's right,the servitude institution could be employed.
