摘要
"民以食为天",食品安全与人民群众的日常生活息息相关,随着一系列问题食品的出现,人们对于食品的安全问题越来越担忧。三鹿奶粉事件引发了社会各界的讨论,尤其是对于现行我国食品安全立法的思考。《食品安全法》的出台顺应了社会发展的要求,然而国家随后出台了三聚氰胺的限定含量标准,此举引起了学术界的广泛争议,对于三聚氰胺这样的非食品添加剂进行限定含量规定是否不妥,是否与现行法律相悖等等。《食品安全法》虽然出台了,但是与之相配套的法律体系并未建立,尤其是针对三鹿奶粉事件而出现的一些问题,如关于食品添加剂标准的立法还不够完善,相关规定缺乏可操作性等,应及时通过立法或司法解释加以完善。
There is an old saying ＂Hunger breeds discontentment＂.Food safety is closely related to people＇s ordinary life.With more and more unhealthy food appearing,people are quite worried about the issue of food safety.Sanlu Formulas Scandal had arouse the whole society＇s discussion,especially the contemplation on the legislation of our country＇s food safety.The formulation of the {Food Safety Law} keeps the pace with the development of the society.However,our country had set the standard of the melamine＇s content.This caused widespread controversies in the academic field.The controversies focus on whether the set of the standard of the melamine＇s content is appropriate,whether it is consistent with the existing law,etc.Although the Food Safety Law has been fixed,the legal system that can complement it haven＇t been established yet,especially in connection with the problems that appeared after Sanlu Formulas Scandal.For example,the legislation of Standards for food additives is not perfect enough and the related regulation lacks operability.All these problems should be improved through legislation or judicial explanation.
