摘要
利益冲突是公职人员的私人利益与其公共角色承担的公共职责之间的冲突,是产生腐败的一个重要根源。防止利益冲突制度建设被认为是预防腐败的有效制度安排。当前高等院校防止利益冲突制度建设正面临着私人利益与公共利益界定不清、缺乏利益冲突风险评估、缺乏独立审查和监督利益冲突机构、文化缺失等困境。防止利益冲突制度建设是反腐倡廉的新领域,需要不断完善相关措施:要明确界定与高校管理人员及教师职责产生冲突的私人利益的类型和行为,合理介入教职员工的个人生活;制定科学的利益冲突风险评估体系,提高防止利益冲突制度的有效性;在国家层面建立防止利益冲突的伦理法规,完善整合现有防止利益冲突的法律法规;加强综合配套措施,完善利益冲突管理流程。
Conflicts of interests refer to the conflict between public officials' private interests and their public roles granted by public duties, which becomes an important source of corruption. The system construction to prevent conflicts is considered to be an effective system arrangement to prevent corruption. The predicament exists in universities' system construction, which in- elude the ambiguous definition between private and public interests, shortage of conflict risk assessment, deficiency of agencies to independently censor and supervise conflicts, and cultural deletion. The system construction to prevent conflicts, a new area of anti-corruption, needs the constant improvement of relevant measures. We must define clearly the types and behaviors of u- niversity leaders and teachers when their duties conflict with their private interests, reasonably get involved in their personal lives, develop scientific risk assessment system, and improve the effectiveness of the system to prevent conflicts. Our government should also establish ethical regulations to prevent conflicts at the national level, improve and integrate present laws and regula tions, strengthen comprehensive coordinated measures, and consummate management processes.
