摘要
高校行政权力控制亟需法治 ,庞大的行政管理机构 ,官多、衙门气重 ,滥施行政权力 ,计划经济体制下造成的高校与政府关系的混乱 ,至今仍然对高校发展产生副作用。依法明确教师的基本权利不可侵犯 ,确立高校行政权力的公益性原则 ,设置高校行政权力的行使范围 ,设定高校行政权力的运行程序 ,坚持高校自主 ,建构保障和促进教学的法律机制 ,确立国家对高校适度干预和宏观调控 ,是目前高校行政权力依法控制 。
Limitation to administrative power of higher educational insiitutions should be urgently put under the rule of law.The huge administrative machinery, which is full of officials and bureaucratic atmosphere, abuses the administrative power. The confusion between the higher educational institution and the government resulted from the planned economy is presently found to have sideeffects on the development of higher educational institutions,so we should take legal measures to bring the administrative power under the rule of law and realize the conformity and the balance within the legal system between the government and the higher educational institution.
