摘要
我国现行民事上诉制度中对上诉的不加限制和二审上诉程序构造的不明确 ,业已造成了诸多弊端和混乱 ,因此需要改革和完善。作法是对上诉加以适当的限制以及对二审上诉程序结构以采续审制为原则 。
The non-restriction to the appeal and the unclear of the appellate procedure structure of the second instance in our country have created lots of deficiencies and confusions;thus needs reforming and perfecting.And the doings are to give proper restrictions to the appeal and to the appellate procedure structure,to take the following-trial system for the principle,and the after-trial system for the exception and addition.
