行政不作为是相对于行政作为而言的行政行为。行政不作为违法同样会给公民、法人及其他组织的合法权益造成损害 ,这种损害 ,国家应承担赔偿责任。在我国以法律形式确立这项赔偿责任 ,对于完善我国《国家赔偿法》
Administrative inactivities are the opposite of adminstrative activities.Administrative illegal inactivities may also cause damages to citizens body corporate and other social organizations,and which should be state compensated.Regulating this kind of state compensation by legal provisions wouldbe quite necessary to perfect the state compensation law and our administrative legislation.
