摘要
《2004/24/欧盟指令》虽然具有规范传统植物药市场准入条件,保护人类安全的作用,但在客观上它还具有限制进口、保护本国同类商品生产者利益的作用。该指令既不符合GATT1994第3条规定的国民待遇原则,也不符合GATT1994第20条规定的"一般例外"原则。我国完全可以通过WTO争端解决机制迫使欧盟废除或修改《2004/24/欧盟指令》。
＂DIRECTIVE 2004/24/EC＂ is a mandatory regulation issued by the European Parliament and the Council of the European Union, which regulates the conditions for the simplified registration and authorization to place a medicinal product on the EU market. This Article analyses the provisions concerning the conditions for application und its procedures and other important contents of ＂DIRECTIVE 2004/24/EC＂. Then it discusses the influences of this Directive on the internationalization and the industry of Chinese medicinal herbs.
