摘要
我国行政复议制度存在需要完善的诸多问题,这些问题与行政复议法律关系主体的基本结构具有重要的关联性。通过对主体关系模型进行分析,行政复议法律关系主体之间基本结构包括三种,即救济、监督以及平等主体关系。行政复议法律关系主体之间关系的良性互动,各有侧重,是实现行政复议目的的关键要素之一,主体关系模型也是重新设计行政复议法律制度的重要考虑因素。
There are some problems to be solved in administrative reconsideration in China, and those problems have some relationships with basic structure of subjects of legal relation of administrative reconsideration. Through the relationship of the main models, three kinds of subjects between Administrative reconsideration law relationships, i.e., supervision and relief of equal legal relationship, having a benign interaction in the administrative reconsideration law relationship ,having each emphasize particularly on the realization of administrative reconsideration, was also redesigned to administrative reconsideration of the legal system in consideration.
