摘要
专利经营公司专门着力于对专利这一特殊资产的经营,实施专利集中战略。但是专利经营公司在美国和中国对专利集中战略的实施模式又有所不同。美国不仅是这种公司的专利获取地,更是其获得收益的市场;而中国在这种战略中则处于专利获取地的位置。通过比较分析发现,两国的专利制度的不同可以为这种差异提供较好的解释。随着美国专利法的改革和中国专利市场的成熟,这种差异正在减少,中国应做好专利商业模式创新的准备。
Patent operating firms focus on a special asset—patents.They implement Patent Concentrating Strategy.But the implementations of the strategy are different between America and China.America is not only the place where the firm collects patents but also the place where the firm gains interest as its market,while China is only the place where it collects patents.The differences of patent systems between the two countries supply a good interpretation.The differences are declining with the reform of American patent system and the maturating of Chinese patent market.It is time for China to make business model innovation.
