摘要
研究目的:了解中国城市地下空间相关的法律建设现状,总结经验教训,为进一步法律建设奠定基础。研究方法:归纳法、案例分析法和比较分析法。研究结果:从1997年建设部颁布的有关地下空间的第一部部门规章开始到现在,各地颁布实施的法律法规已经有32部,这些法律法规涉及城市地下空间的管理体制和机制、产权归属、与地表的关系、开发利用规划、交易转让等各个方面。研究结论:与地下空间相关的法律建设速度很快,同时也存在一些问题:(1)覆盖范围小、法律效力低;(2)不同法律法规之间还存在内容上的冲突;(3)在一些重要内容上缺乏相关规定。因此,进一步完善需要:(1)对已有的城市地下空间法律法规进行修改、补充和完善;(2)对涉及城市地下空间的其他法律法规的相关条款进行修改、补充和完善;(3)制定国家层面的法律法规。
The purpose of the paper is to explore the present legislation on the urban underground space in China and summarize the lessons of it, aiming to provide the basic reference for future legislative development. Methods of comparative analysis and case study are used. The results show that since the first department regulations on urban underground space was promulgated by the Ministry of Construction in 1997, around 32 laws and regulations have been issued and implemented by the local authorities. These laws and regulations cover the urban underground space management system mechanism, property ownership, and surface relations, development planning, and the transactions, etc. However, there also exist some problems. Firstly, the coverage of the law and regulation is narrow, and the effects are inexplicit. Secondly, there exist some content conflict between different laws and regulations. Thirdly, some important contents are lack of relevant provisions. Therefore, some measures should be taken for further improvement. Firstly, the existing laws and regulations on urban underground space should be amended, supplemented and ameliorated. Secondly, the provisions related to city underground space in other laws and regulations should also be amended, complemented and ameliorated. Thirdly, national level laws and regulations must be formulated.
