摘要
预告登记制度源于普鲁士法的异议登记,并为德国、日本等国家所继受。新中国成立后,我国未建立统一预告登记制度,与其有关的规定散见于地方性法规中。《物权法》首次系统引进此制度,实为立法一大进步之举。本文从一房二卖的困境出发引出预告登记制度,并在对我国调整规则进行探析之基础上,提出一些建议,以期预告登记调整规则日臻完善。
The rules of the pre - registration originate from the dissenting registration in the Prussian law and are adopted by Germany, Japan and other countries. After the founding of new China, a unified registration system was not established, and some related rules can he read in the local laws. Property Law introduces this system for the first time, which is a great progress in legislation. The article starts from the plight in the house - sale and gives introduction to the rule the pre - registration. It gives some suggestions on the basis of the analysis of rules of regulation in China, hoping to improve the pre - registration rules.
