摘要
何以追求公正、呵护公正是中国特色社会主义仲裁价值体系的基本追求,《仲裁法》颁布至今,关于仲裁机构性质定位的学术之争可谓盖棺定论。然而在实践操作中其行政化的倾向却屡见不鲜,归根结底乃是基于其得以滋生的法制环境具有浓厚的行政底蕴。行政化,于仲裁制度而言,兼备内在张力、外在助力、外围阻力三者特性,并通过人事任免、运作逻辑、财政收支等方面加以显现。改革之法应以司法监督、行业监护等为出发点,切实把握力度、规模等因素,旨在建立健全一种切实可行、刚柔并济的改革模式。
The realization ard maintainence of fairness is the basic pursuit of arbitration value system.Since the promulgation of the arbitration law,the academic controversy over the orientation of the nature of arbitration organization has arrived at a conclusion.In practice,however,there is always a tendency of administration which,in terms of arbitration system,has the characteristics of internal tension,external assistance,and surrounding resistance,and is embodied in three aspects: personnel appointment and removal,operation logic,and financial budget.The law of reform should start from the angle of judicial supervision and trade tutelage,substantially take into consideration such factors as the strength and scale so as to establish and improve a feasible mode of reform which couples hardness and softness.
