摘要
未成年人身心的特殊性,要求对未成年人适用刑事诉讼程序时应给予特殊的保护和照顾。司法实践中,未成年人与成年人共同犯罪案件经常出现,而新《刑事诉讼法》并未对此规定特别的起诉程序。因此,在未成年人犯罪案件诉讼程序立法化的背景下,有必要从法律规定的漏洞和实践中存在的问题出发,对分案起诉制度进行全面的研究。通过对问题进行分析并提出对策,评析司法现状,提出合理化建议,促进未成年人与成年人共同犯罪案件分案起诉制度的完善。
Due to the specific characteristics of minor＇s physical and mental, it requires special protection and care during a procedure of criminal action. In judicial practice, the joint crime by minor and adult appears frequently, while the corresponding special prosecution procedure still absent in new criminal procedure law. Therefore ,with the background of legislation in minor crime procedure, it is necessary to launch a Comprehensive study about the separated prosecution system from the Insufficient of legislation and the problems existing in the practice. Make comment on the judicial practice by analysis problems and given solution, and then promote to perfect the separated prosecution system of joint crime by minor and adult.
