摘要
民事政策是国家对民事领域的民事活动进行导引和规范的法政策,在具体的民事法律关系利益衡量中,民事政策自觉或不自觉地通过各种因素起着重要的作用。民事政策是民法适用解释的辅助依据,也是民事法律法意解释适当性衡量的重要标准。民法适用解释进行政策性考量具有正当性,利于深化立法原意,契合现时代民事实践的需要。法官引民事政策适用民法解释,能有效规范司法审判自由裁量权的适用,从而弥补社会有机体法律之治的欠缺。
Civil policy is the law policy of one country to instruct and regulate the civil activities which plays an important role through various factors voluntarily or involuntarily in measuring the interests in civil legal rations.It is the auxiliary basis of the civil law application interpretation and also the important criteria for judging the appropriateness of the civil law meaning interpretation.The policy measurement on the civil law application interpretation is legitimate which is helpful to deepen the legislation purpose and to conform to the requirements of the current civil practice.The adoption of civil policy in the interpretation of civil law can effectively regulate the application of judge＇s discretion in judicial trial and remedy the deficiency in law ruling of the social organism.
