摘要
中国法律逻辑研究起步于30年前的改革开放,30年来,从无到有,逐渐成为一门独立的、生机勃勃的学科,其发展历经形式逻辑为纲阶段、现代逻辑为纲阶段以及现代的多元发展阶段,取得瞩目的成就,也产生了许多基本问题和热点问题,如法律逻辑的学科性质、学科基础,法律推理及法律论证问题都值得思考和研究,找出其经验和不足,以期为我国法律逻辑研究的下一步发展打下基础。
Chinese legal logic research started about thirty years ago. From then on, it has become anindependent and alive discipline from scratch. Its development can be divided into three stages, the formallogic as the key link stage, modem logic as the key link stage and modem pluralistic development. Obtainedremarkable achievement, also produced a lot of many basic problems and hot issues, such as the nature oflegal logic, logical foundation of legal logic, legal reasoning and legal argumentation problems are worththinking and studying. Therefore, we find out the experience and deficiency of legal logic research, and offera foundation to our further development.
