摘要
义工组织作为一种新兴的公民社会组织,其孕育与形成期均带有明显的去政治化、去政府化倾向,需要建立相应的法律制度去约束、规范其行为,并引导其走上健康、良性的公共服务轨道。但我国义工组织法人化面临着一系列的制度障碍,亟需社会管理与社会制度创新,以化解和排除义工组织法人化发展的困境。
As an emerging civil social organization, the volunteer organization in its period of incu- bation and formation had significant trend of de-politicized and de-government, needed to restrict and regulate its behavior by establishing the appropriate legal system, led it to go a healthy and good path of public service. While the legal personalization of the volunteer organization in China was facing a series of institutional barriers, needed to innovate upon the social management and social system to resolve and defuse the barriers of the development of the legal personalization of the volunteer Organization.
