摘要
调审分离工作有其必要性,主要是提供了独立的调解程序空间,利于提高调解工作的效率。在调审分离的节点把握上,还应考虑符合审判规律,避免司法资源浪费,尊重当事人意愿,利于提高法官的综合能力及业务水平。因此,调审分离应从考核上及分离机制上下功夫,才能达到应有的效果。
It is necessary to practice separation of conciliation and trial, mainly for the reasons that the separation provides independent conciliation procedure space and that it helps raise conciliation efficiency. When we decide the separation, we should consider conforming it to regular trial patterns, avoiding wasting judicial resources, respecting the will of the parties and helping to improve judges＇ comprehensive abilities and professional skills. Accordingly, we should make great efforts to make assessment and build a separation mechanism so as to achieve desired effects.
