摘要
软法之治已被视为满足公共治理需求、强化法治建设的重要路径。但当下中国,软法理念尚未成形,软法在中国面临着理论和制度上的多重问题:软法治理理论依据之建构,忽视了制度与规则的精细设计;对软法治理的定位与评价,满足于工具化的解读,忽略了社会治理观念和治理能力的跟进;适用软法的同时,有关软法治理的范围和限度尚未能准确澄清。由此,为软法治理的存在及定位提供必要的观念和制度空间,确为时之所需。
The soft law is viewed as a major path to meet public governance demand and to enhance rule of law construction. However in current China, the soft law concept is still yet-to-form, facing many problems in theory and in system, i.e. the theoretical basis construction ignores the delicate design of the system and rules, the positioning and evaluation only satisfying the tool interpretation ignores the follow-up of social governance concept and capacity, the application lacks clear definition of scope and limitation. So, it is high time to provide the existence of soft law with necessarv space of concept and systems.
