摘要
随着城市化进程的加快和公共设施的增加,农村集体土地的征收与补偿已不可避免,土地征收关系到国家、集体及个人的利益冲突和利益平衡,如果征地补偿制度不公平、不合理、不规范,征地不仅会造成财富的损失,还可能激化矛盾。鉴于目前集体土地征收制度存在诸多不足之处,通过对我国相关的法律法规探析,着重分析我国集体土地征收的条件、程序及征地补偿制度等问题,尤其在完善我国集体土地征收的基本构想方面,就"公共利益"范围的可行性思路提出见解。如何在现行法律制度下进一步完善我国农村集体土地征收与补偿制度,是我们迫切需要解决的一个重大问题。
In recent years, with the accelerating process of urbanization and the increasing of public facilities, the collection and compensation of rural collective land have been inevitable. Land requisition is related to the conflict and balance of interests between the state and individual. If the land compensation system is unfair, unreasonable and non-standard, land requisition not only will cause the loss of wealth, but also may intensify the contradiction. Therefore, how to further improve our expropriation and compensation system of rural collective land under the current legal system is a major problem ,we need urgently to solve. So ,the current system of col- lective land expropriation has many defects, this article focuses on analyzing the requirements, procedures and compensation system of our collective land expropriation through researching on the relevant laws and regulations of China. Especially, in terms of the basic concept of improving collective land expropriation, the author puts forward his own views of the feasibility ideas on the scope of ＂public interest＂, expecting to build and improve our collective land expropriation system.
