摘要
由于知识的商业化,大学里学术开始成为一种资本,学术与产业的关系越来越密切。为维系学术—产业链的正常运转,以专利和版权为核心的知识产权制度被嵌入大学制度。专利和版权制度的引入一方面给大学带来了可观的办学资源,另一方面也损害了知识的公共性,危及大学制度的正当性。未来好的大学治理就是要在知识的商业性与大学的公共性,强化知识产权与削弱知识产权之间保持微妙的平衡。
Because of the commercialization of knowledge, academic has become to be regarded as a form of capital, which has close relationship with industry. Patent and copyrightoriented intellectual property system is embedded in universities in order to maintain the normal operation of academic-industry chain, which brings sufficient school-running resources obviously. Unfortunately, it damages the publicity of knowledge, jeopardizes the justifica tion of the university system as well. The perfect university governance in the future is to keep a delicate balance in the commercialization of knowledge and publicity of university as well as the strengthening and weakening of the intellectual property rights.
