摘要
知识产权保护是决定整个动漫产业存续与发展的重要因素。分散的法制、割裂的法律实施体制和个体化的企业运营管理机制,是动漫产业知识产权保护中的突出问题。解决动漫产业的知识产权保护问题,必须立足动漫产业知识产权聚集的特性,采取整体化的进路,在法制、体制和机制的制度创新框架中寻求解决对策,促进立法制度的融通、法律实施体制的整合、运营管理机制的集中。
The intellectual property protection is important to the survival and development of the animation industry.The decentralized legal system,fragmented implementation system,and the individual mechanism of operation and management are the outstanding problems.To solve the problems of intellectual property protection for animation industry,we should take the holistic approaches to promote the legislative system harmony,make the law enforcement systems integrated and the mechanism of operation and management concentrated,from the innovation framework of rule of law,institutions and mechanisms.
