摘要
大规模侵权一旦发生,会给众多的人造成损害,对这些损害的救济不仅事关被侵害人的切身利益,而且一定程度上会影响到公共安全和社会稳定。政府介入大规模侵权事件,为被侵害人的损害救济提供便利条件,对被侵害人实施救助,是政府的职责所在。探索建立政府介入大规模侵权损害救济的机制,比如政府介入的条件、方式、管理体制、行为约束规则等,其目的在于为政府介入提供规则指引,规范政府的介入行为,从根本上说,是为了充分救济大规模侵权受害人,实现权益保护和社会和谐的目的。
Once mass torts occur, many people will be damaged. The damage relief not only relates to the vital interests of the victims, but also public security and social stability to some extent. The government intervenes in mass torts and provides facilities and social assistance to the victims, which are the government＇s responsibilities. In oder to provide the government with rules guidelines and regulate the government＇s intervention, fundamentally speaking, give full relief to the victims and achieve the purpose of rights protection and social harmony, it is necessary to establish the mechanisin of government＇s intervention in damage relief of mass torts, such as conditions, methods, management systems and behavioral constraints rules of government＇ s intervention.
