摘要
治安法官制度是英国传统治安体制的核心,从治安法官制度的产生与沿革入手,探究了其任职的资格、履职的形式及所发挥的作用等内容。总结出了其自身的特点,发挥的重要作用,特殊的历史地位。通过对英国这一独特的历史现象的研究,帮助我们更好地理解英国现行的法律制度,从中得出一些有利于我们社会发展的有建设性的经验和教训。
Justice of the Peace is the core of the traditional English magistrate system.Based on the emergence and evolution of the English magistrate system,this paper explores the qualifications of holding the post,the forms of performing administrative functions and its roles.Then the paper summarizes the characteristics of the Justice of the Peace,the important role it plays in and its particular historical status.Thus it is helpful to understand the present legal system of the Great Britain and have constructive experience built on such research.
