摘要
2012年《刑事诉讼法》中在特别程序一编增加规定了未成年人刑事案件诉讼程序一章,旨在肯定多年来未成年人刑事诉讼的司法实践经验,特别是首次在立法中确立了社会调查制度、附条件不起诉、合适成年人在场、犯罪记录封存四项新制度颇为引人关注。本文分析四项新制度的内涵与未来适用展望。
A new part on Juvenile criminal justice was added to Revised Criminal Procedure Law,which absorbed judicial practices in past several years in China.There are four new elements in the new law： social investigation on background of juveniles;conditioned non-prosecution;proper adult present during criminal process;keep criminal record confidential.
