摘要
海难救援优先权是一类被国际公约和各国海商法广泛认可的海事优先权。南非的海难救援优先权制度颇具特色,主要体现在:人身救援报酬有独立的优先权,体现了对人的关怀和对人的生命权利的重视;明确规定行使海难救援优先权的权利人,有利于维护优先权人的合法权益;实行对物诉讼,大大减少了实现海难救援优先权的成本和风险。南非海难救援优先权制度,对完善我国的海难救援优先权制度具有重要的启示意义。
Salvage maritime lien is a kind of maritime lien that widely confirmed by international convention and the maritime law in various countries. The salvage maritime lien legal system has distinguishing features which mainly manifested in the following aspeets. The claim of life saving is granted an independent maritime lien that shows the caring about people and attaches the importance to peo- ple ＇ s right of life. The obligee who can execute Salvage maritime lien is stipulated definitely that helps the lienee to protect their legiti- mate rights and interests. The cost and risk of implementing the Salvage maritime lien is reduced greatly by executing action in rem. The salvage maritime lien in South Mfrca provides an important enlightened significance for completing the Salvage maritime lien in China.
