摘要
近年来我国学术界逐渐重视对土地发展权的研究,然而其研究仍处于起步阶段。本文采用文献资料法和比较分析法等,在介绍国外土地发展权制度的运行现状的基础上,分析归纳了现阶段国内学术界关于土地发展权的涵义、创设的必要性与可行性、归属、配置与流转、价格评估等方面的研究内容,并探索当前研究中存在的不足和今后需要努力的方向。
Abstract： In recent years importance has been attached by academe to the research of land development rights in china. However, the re- searches are still on the fundamental stage. Applying such methods as documentation and theoretical analysis, on the basis of introducing operation situation of land development rights institution oversea, this paper analyses and summarises the concept, feasibility and necessity, attribution, allocation and transfer, price evaluation of land development rights, exploring the shortcoming and the future directions of the researches.
