摘要
刑事犯罪庭审过程中引入量刑建议制度是时代的需要。目前量刑建议制度在我国处于试点阶段,在此阶段中暴露出提出量刑建议主体不明;量刑建议适用范围不明;量刑建议提出方式不明;量刑建议具体内容不明等等问题。文章认为应总结经验,对我国量刑建议制度进行规范。
It is necessary to introduce the Sentencing Proposal System into our criminal trial process. Now,the Sentence Recommendation System in our country is in the pilot phase, and has some prob- lems at this stage. The paper holds that a summary of the experience will help standardize this senten- cing system.
