摘要
世贸组织法律体系中含有一些环境保护法律规范即“绿色条款”。包含有“绿色条款”的世贸组织单行协议有《关贸总协定 1994》、《补贴与反补贴协议》、《卫生和植物检疫措施协议》、《技术贸易壁垒协议》、《服务贸易总协定》和《与贸易有关的知识产权协议》等。这些“绿色条款”体现了世贸组织的环境政策。世界贸易组织的贸易与环境委员会等机构 。
There are a lot of provisions concerning environment protection in various agreements, such as GATT 1994, SPS, TBT, GATS, TRIPS, in the WTO law systems. All these “green clauses” stand for WTO's environmental policy. WTO plays a very important role in harmonizing relations between environment and trade. WTO has established committee on trade and Environment handling environmental matters arising from international trade, including transnational sale of hazardous industrial products. WTO has paid much attention to environment protection in settling disputes between WTO members facing trade measures for environmental purposes.
