摘要
将改革开放以来国内学术界关于农村土地制度及改革的众多研究成果,以不同主题的方式,分别从"法律与产权、公平与效率、权利与利益、公有与私有"等不同关系的角度,予以逻辑分析,揭示当代中国农村土地制度存在的主要缺陷和改革的核心问题,以达到限制公权力对农民土地权利的肆意侵夺,使土地增值利益的分配更倾向于"三农"的目的。
There are a large number of research results in domestic academic circle about rural land system and reform since the reform and opening up.This article attempts to make these results a logical description by ways of various subjects from the perspective of various relations like ＂legal and property rights,fairness and efficiency,rights and interests,public and private＂.It intends to demonstrate the main defects in contemporary Chinese rural land system and the core problem in reform so as to restrict state power from willfully depriving of farmers＇ land right and to make the advantage of land increment inclined to villagers,countryside and agriculture.
