摘要
探讨了ＢＯＴ特许协议的定位、东道国作为ＢＯＴ主体的身份确认等法律问题。作者认为ＢＯＴ特许协议属于国内契约，指出ＢＯＴ特许协议的东道国主体只能是中央政府。
An inquiry is made about the BOT special-Permit-Agreement and the adjustment of its subject capacity. The agreement should belong to internal contracts, and only its central govrvernment can represent a host country to be one of the two parties of the agreement.
