摘要
期刊全文电子数据库涉及到期刊文章的作者、期刊的编辑出版者和数据库制作者三种著作权人。期刊全文电子数据库要想获得合法的保护,必须先获得合法、有效的著作权授权。期刊全文电子数据库制作者可以通过获得期刊文章作者及期刊编辑出版者许可得到授权,但在此过程中会遇到许多现实的问题。为了妥善解决好这些问题,我们可以从以下三个方面入手:建立期刊著作权集体管理组织;采取"著作权法+反不正当竞争法+合同法"的保护模式;尽快制定独立的数据库特殊权利保护制度。
Electronic database of full-text journals related to three types of copyright owners, they are the au- thors of journal articles, journal editors and publishers and database owner. Producers of electronic database in order to obtain legal protection must obtain a legal and valid copyright license. Producers of electronic database licensed by the two channels, but in the actually they faced the difficulties. In order to solve these problems properly, we can start from the following areas such as establishinq and improveinq system of collective management organiza- tions, taking the mode of ＂ Copyright Law ＋ Against Unfair Competition Law ＋ Contract Law＂ to protect electronic database of full-text journals, developing independentdatabase protection system as soon as possible.
