摘要
变性人通过变性手术实现性别转换在医学、伦理以及法律上素有争议。本文认为,变性是变性者的心理和生理需求,而变性手术又是变性者有效的治疗方案,基于人格尊严、人格自由等一般人格权,基于生命权、健康权、身体权等具体人格权,变性者请求施行变性手术,借助医疗技术以摆脱心理上的痛苦的自由和权利应当作为变性者特有的一项权利被法律允许和确认,并在立法上制定相应的规则加以保障。
Transsexual gender change by a sex change operation has controversy in the medical,ethical and legal.Degeneration is a transsexual＇s psychological and physiological needs,and transgender sex change operations is an effective treatment program,based on human dignity,personal freedom,Personal Rights,based on the right to life,health,physical right and so on,transgender request the purposes of sex change operations,medical technology through the pain out of psychological freedom and rights of transgender people should be as unique a right to be permitted by law and recognized in the legislation to protect the development of appropriate rules.
