摘要
判断第三方插件是否侵犯宿主软件著作权,需要考虑最终用户、第三方以及宿主软件著作权人三方的法律关系,以及第三方插件如何影响了宿主软件的功能。对于未经授权的第三方插件改变宿主软件的功能,从技术手段上来看是修改和拦截。修改可能会侵犯宿主软件著作权人的修改权,拦截则会侵犯宿主软件著作权人的保护作品完整权和信息网络传播权。开发者应当考虑开发插件是否会影响宿主软件的性质和功能,避免自己的插件作品侵权。
To determine whether the host software copyright is infringed by third-party plug-ins,we need to consider the legal relationships of end users,third-party and software copyright hosts.We also need to consider how third-party plug-ins influence the function of the host software.Unauthorized third-party plug-ins＇ function to modify the software host is technically modification and interception.The former may infringe the copyright owner＇s right of amending,and the latter may infringe the rights of work integrity protection and information network transmission.Developers should consider whether the development of plug-ins will affect the nature and function of the host software to avoid infringement of their plug-in works.
