摘要
对于公共权力执行者(公权人员)的角色,在不同的历史时期和不同的文化背景下,会有不同的理解。长期以来,我国执行公共权力者角色定位不明晰,导致"官"民关系不清,权力缺位和越位。研究认为,对公权人员要从理性人和制度人的假设出发去定位。在我国道德政治色彩很浓的现实情况下,公权人员要以制度人角色超越道德人角色;以清晰角色定位理解契约责权;以公共权力"产权"明晰界定公权人员与民众合约关系中的权利与义务,以公权人员个人人力资源而不是权力的属性获得其合理合法收益。
In different historical periods and different cultural backgrounds,there are different understandings to the role playing of the persons who exercise the power of public right.But their role playing in our country is not clear for a long time in our mind,which leads to ambiguous relation between the official and people and results in vacancy and offside of the authority.The public power executors should act as not only moral people but also system people,and clear their role playing based on understanding the contract of liability or rights.We should draw a line between the public right and the private rights by the contracts between public power executors and common people.The public power executors should take advantage of their own human resources rather than the attribute of the public power to gain reasonably legitimate profits for themselves.
