摘要
重庆市某检察分院及辖区基层院通过开展量刑建议改革试点,促进了刑罚裁量的公开公正。但调研发现,量刑建议在适用范围、形成机制、建议内容、提起方式、变更机制、评价机制等方面还存在一些问题,须通过转变司法理念、强化诉讼构造、完善配套机制等来加强和改进量刑建议工作。
A branch of Chongqing People＇s Procuratorial and the basic-level procuratorial committees facilitated the openness and fairness in penalty measuring by carrying out experimental reformation on sentencing suggestion.However,an investigation on sentencing suggestion shows that there are problems to be resolved in its scope of application,formation mechanism,contents of suggestion,the way of proposing,perfecting complementary mechanism,evaluating system,etc..Sentencing suggestion shall be improved by changing our judicial conception,strengthening proceeding structure and perfecting complementary mechanism.
