摘要
被征地农民参与土地增值利益分享的正当性基础是集体土地所有权中的土地利用方式变更权能。集体土地征收中土地增值收益的分配显失公平。我国目前的土地权利体系无法为被征地农民提供参与土地增值利益分配的权利基础。创设土地开发权并构建其实现机制,是保障被征地农民公平分享土地增值利益的权利源泉。我国被征地农民土地开发权的实现,在区分公益性征地和经营性征地的基础上,实行国家购买土地开发权和土地开发权交易相结合的方式。
The right to change land use is the legitimacy basis for expropriated farmers to share land appreciation.In expropriation of collective land,the distribution of land appreciation is not fair.China's land rights can not provide the expropriated farmers with participation in distribution of land appreciation.Creation and realization of Land Development Right(LDR)can guarantee the expropriated famers to fairly share the land appreciation.Realization of LDR in China,based on the compartmentalization of expropriation for public interests and expropriation for business interests,should combine the Purchased Development Right and Tradable Development Right.
