摘要
人肉搜索对现实的影响有目共睹,赞叹与质疑之声从未消弥。国家已从地方层面开始试水对其规制,然而却因理论上研究不足使其饱受诟责,并在法律与舆论的边缘徘徊。以死亡博客为例,从宪政视野来分析人肉搜索的实质,可从理论上和实践上提出具体的规制。
The impact of human flesh search on reality is obvious,however,the affirmative and negative comments on it never diminish.China has been trying to regulate it from the local government,but it has met a lot of troubles because of lack of theoretical explorations and only wanders in the brink of law and public opinion.Based on death blog,this article analyzes the essence of human flesh search from a constitutional perspective and proposes some new viewpoints both in practice and theory.
