摘要
农村被撤并学校产权争议成为当前各地急需解决的法律问题。当前争议主要集中在土地使用权归属、校舍房产权属、土地附着物权属、债权债务承担等四个方面。导致争议产生的原因主要在于政策变化过程新的利益平衡机制尚未建立、争议主体层级性导致契约规则难以达成、土地建筑物主体不同一与现有法律制度冲突等。解决这些争议,需要按照"谁投资、谁所有"、平等协商、同一处置、物尽其用的原则分类进行。
Assets disputation of closed and consolidated rural schools has become an urgent legal problem that needs local governments to deal with at present. The assets disputation mainly focuses on the land employment rights, school building rights, items attached to the land rights, obligatory right & obligation, etc. The origins of the disputations lie in a lack of the interest balance system resulted from the policies change, a lack of contracts because of the administrative level, the contradiction with the present legal system because of the different land employment righter and school buildings righter. To resolve these disputations, we need clarify property rights, and follow the principles such as investors profit from their investments, equal consultation, substantive whole handling, and exhaust the Use of Property.
