摘要
生育护理假是国家通过法律赋予男职工在妻子生育时所享有的照顾配偶和婴儿的假期。目前我国把生育护理假作为计划生育奖励手段具有局限性,忽略了职工的基本需求,不利于职工权益保护,也与国际社会保障立法趋势不相符,因此我国应该赋予男职工享有生育护理假的权利。生育期间家庭收入降低、支出增加,为了保障职工休假权的实现,特别是低收入群体能够实现休假权,国家应该通过生育保险制度为其在生育护理假期间提供津贴保障。如果男职工确实因工作需要无法休假,单位应向其支付经济补偿。
Paternity leave should be a basic right granted by national law to workers to enable them to shoulder familial responsibilities after the birth of children.However,at present,paternity leave is a reward tool of family planning in China and has certain limitations.This overlooks the basic needs of workers,goes against international labor and social security legislations and does not protect worker rights and interests.It is therefore recommended that workers be endowed the right to enjoy paternity leave in China with their allowances being provided by maternity insurance during the leave period.If male workers are unable to claim paternity leave for income reasons,the employing unit should supply a tending subsidy or double wages.
