中央对手方理论下的期货交易所法律地位研究

摘要 在期货交易中,期货交易所作为中央对手方成为卖方的买方、买方的卖方,承担担保履约功能。从中央对手方角度研究期货交易所的法律地位有非常重要的意义,成熟期货市场对期货交易所作为中央对手方的地位都有规定。建议我国在未来期货市场立法中引入中央对手方的概念,并对期货交易所作为中央对手方的权利义务作出明确规定。
