摘要
随着物权法的颁布,土地承包经营权的物权性质逐渐得到认可,土地承包经营权作为一种独立的用益物权,符合遗产的特征,应当成为继承权的客体。同时允许土地承包经营权的继承,应对其继承的方式加于规定并遵循一定的原则。
After the promulgation of Chinese Property Law,the property of land contractual management rights has gained recognition gradually.As a standalone usufruct,the land contractual management rights pertain to inheritance and should be an object of the right to inheritance.Allowing the inheritance of land contractual management rights should follow certain principles,meanwhile,rules regulating the inheritance should also be made.
