摘要
所有权是产权"权利束"中最基本的权利,民办高校产权问题之所以长期制约民办高校的发展,根本原因就是民办高校的所有权缺乏清晰的界定。目前,民办学校举办者出资部分所形成的校产的所有权已基本明确,但办学累计资产的所有权尚未明确。在所有权弱化的条件下,举办者所掌握的控制权以及控制权回报构成了对举办者努力办学的回报。"分类管理"的实施为最终解决民办高校的所有权问题提供了前提条件。
The ownership is the core of the property rights and it determines the other property rights for non-governmental institution of high learning.The ownership of non-governmental institution of high learning is not clear,which hinder the development of the private university.Nowadays,the ownership of school property formed by the funding organizer is basically clear,while the ownership of running assets is unclear.Thus,under the condition of weakening ownership,the organizers' control of the possession and the return of the control comprised the benefit for organizers."Category management" provided preconditions to implement the final settlement of the ownership of non-governmental institution of higher learning.
