摘要
法律所采取的形式是与特定的传统思想相联系。普通法的因循先例的方式是与英国传统思想中的经验主义分不开的。经验主义的思想在判例法中得到了具体的表现。传统思想与法律形式一致性的内在要求对我国的法律建设具有现实的指导意义。
The law has close connection with certain tradition ideology.The form of ”following previous cases'cannot be separated from the empiricism in English tradition ideology.The empiricism in the ideology has its manifestation in case law.The consistent of tradition ideology and legal form has guiding effect on the legal development of our country.
