摘要
专利制度一方面保护技术创新,促进了科技进步,另一方面又存在垄断,具有不利知识扩散的局限性。历史上关于专利制度垄断性的争议由来已久,在分析了专利垄断的合理性的同时,分析了专利制度的局限性,并针对这些局限性提出了一些建议。
Patent system on one hand protects technological innovation,promotes the progress of science and technology;on the other hand,it has its limitation of monopoly for knowledge diffusion.In the history,the controversy of the patent system monopoly has been long-standing.This paper analyses the rationality of the patent monopoly,at the same time,gives an analysis of the patent system＇s limitations,and in the light of these limitations presents some suggestions.
