摘要
在我国,自然人的形象利益还是一个新生事物,它是一种应然的法益而非实然的法定权利。通过对财产权劳动理论、经济激励理论、利益衡平理论的分析,可以为形象利益保护提供有力的法理支持。而注意力经济和大众传媒的发展、市场经济资源优化配置的必然需求则可以为形象利益保护提供有力的社会基础支持。
In China, the image interest of a natural person is a new thing. It is not a legal right but an ought-to benefit. Labor theory of property rights, economic incentive theory, and equity theory of interests can provide strong legal protection for the image interests. The development of attention economy and mass media, and the demand from the optimal allocation of marketing economic resources will provide a strong social support to protect the image interests.
